According to new legislation that has passed both chambers of the South Dakota legislature, athletes in South Dakota primary schools and colleges will be forced to participate in sports with peers of the same gender.

Senate Bill 46 was unanimously approved by the South Dakota House of Representatives on Tuesday, after a 50-17 vote.

Schools must form teams based on the biological sex at the birth of athletes who are participating. If a team is designated a girls team, for example, biological boys will not be allowed to compete.

As Noem said during a recent appearance on "Fox News Sunday," the issue is about fairness and making sure girls have a fair chance to be successful and have a shot at winning scholarships and playing professional sports. We want them to have that chance.

She explained, "Title IX fought for this year ago and I've been fighting for it ever since, she explained, "starting almost five years ago with rodeo, where girls' events were protected. I'm bringing a bill to Congress, which I hope will be the strongest bill in the country regarding girls' sports fairness, and I'm hopeful that my legislators will support it."
